- Agreement to Terms and Conditions
By purchasing products from Goulter’s Vinegar Products Ltd (“Goulter’s”, “We” and “Us”) or using this website the Customer (“The Customer”, “You” and “Your”) agrees to the following Terms and Conditions of sale.
- Satisfaction
Your satisfaction is extremely important to us. Any problems will be addressed in a friendly and efficient manner, with your total satisfaction as our over-riding concern.
- Pricing
All prices shown are in New Zealand Dollars. We do not accept any other currency. Your credit card issuer may apply charges for currency conversion. Goulter’s will not cover the cost of these charges or accept responsibility for any currency conversion charges.
3.1 GST – Goods and Services Tax
All prices on our website are New Zealand GST (Goods and Services Tax at 15%) inclusive. Sales to customers outside of New Zealand will be exempt from the payment of GST but may be subject to the payment of taxes and charges in their country.
- Payment
We accept Visa, MasterCard, AMEX and JCB. We also accept payment by direct credit into our bank account. Items will be dispatched once full payment has been received. If choosing to pay by direct credit we will include our bank account details in the confirmation email you receive when you submit your order.
4.1 Incorrect Bank Account Number
Where Goulter’s Vinegar gives the customer the choice to pay by direct credit, if the customer credits money to the incorrect bank account number, and the correct bank account number was provided to the customer by Goulter’s Vinegar then Goulter’s Vinegar will not accept any responsibility for correcting payments and dispatch of goods may be delayed.
- Delivery of Goods
Depending on order size, the cost of delivery may be in addition to the price of the vinegar product/s. All orders dispatched to an address within New Zealand are delivered door to door, except for WeedX which cannot be delivered to rural addresses as it is classified as ‘Dangerous Goods’.
We use PBT couriers for small orders and Mainfreight for larger orders. Within New Zealand we are able to track and trace all orders dispatched.
The Customer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery. Delivery of goods to a third party nominated by the Customer is deemed to be delivered to the Customer for the purpose of this agreement.
Goulter’s shall not be liable for any loss or damage whatsoever due to failure by Goulter’s to deliver the goods promptly or at all, where this was due to circumstances beyond the control of Goulter’s.
- Title
Goulter’s and the Customer agree that ownership of the Goods shall not pass until the customer has paid the amount owing for the particular Goods. Receipt by Goulter’s of any form other than cash shall not be deemed payment until that form of payment has been honoured, cleared or recognised and until then Goulter’s ownership or rights in respect of the Goods shall continue.
- Delivery Estimates
All orders sent within New Zealand are targeted for delivery between 2-5 working days. Delivery to rural areas will take longer than delivery to urban areas. Goulter’s makes every effort to ensure that delivery timeframes are accurate, however, the delivery times stated assume that there are no unforeseen events. By placing your order, you agree not to hold Goulter’s liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimate time frame.
- Addressing
If any order is found to be mis-addressed by Goulter’s then Goulter’s will be responsible for the re-delivery, replacement or refunding of the item(s). If the customer is found to have given an incorrect or insufficient address, then Goulter’s will not refund or resend the product and all responsibility will be borne by the customer.
- Faulty Product
We endeavour to provide product in perfect condition. The Customer shall inspect the Goods on delivery and shall within 15 days of delivery (time being of the essence) notify Goulter’s of any alleged defect, shortage of quantity, damage or failure to comply with the description. The Customer shall afford Goulter’s an opportunity to inspect the Goods with a reasonable time following delivery if the Customer believes the Goods are defective in any way.
If the Customer fails to comply with these provisions the Goods shall be presumed to be free from any defect or damage. For defective Goods, which Goulter’s has agreed in writing that the Customer is entitled to reject, Goulter’s liability is limited to replacing the Goods.
- Returns
Returns will only be accepted provided that:
- The customer has complied with the Faulty Products provision; and
- Goulter’s Vinegar has agreed in writing to accept the return of the Goods; and
- The Goods are returned at the Customer’s cost within 30 days of the delivery date; and
- Goulter’s Vinegar will not be liable for Goods which have not been stored or used in a proper manner; and
- The Goods are returned in the condition in which they were delivered and with all packaging, brochures and instruction material in as new condition as is reasonably possible in the circumstances. The original invoice/ receipt must accompany the returned item.
We strongly advise all customers to check goods thoroughly upon delivery.
- Receiving a Refund
Once your Goods have been returned to us within the above stated time frame, unless otherwise authorised by Goulter’s, we will begin to process your refund request. All undamaged, correctly returned products will be credited to the original purchaser’s bank account, including GST. You will be notified via email to the address listed on your account when the transaction has taken place.
Only items which Goulter’s can confirm as new and unused will be eligible for a refund or exchange. If we receive your return in a condition which we feel is not fit for exchange or refund we shall get in touch with you to discuss next steps. Goulter’s reserves the right to refuse a return or exchange for any item sent back in a condition where the item has been damaged.
- New Zealand Law
Any goods supplied or sold by Goulter’s Vinegar, are sold under the conditions of New Zealand Law.
Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in case of any conflict, the provisions of that Act will apply.
If the Customer is acquiring Goods for the purpose of a trade or business, the Customer acknowledges that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of Goods by Goulter’s Vinegar to the Customer.
